[ARCHIVED] Ordinance 2021-17 (Fireworks and Pyrotechnics)

Notice is hereby given that at the regularly scheduled public meeting of the Board of Commissioners of Manheim Township, Lancaster County, Pennsylvania to be held on Monday, October 25, 2021 at 6:00 p.m. at the Morgan Program Center, Manheim Township Public Library, 595 Granite Run Drive, Lancaster, Pennsylvania the Board will consider for enactment proposed Ordinance 2021-17. The full title is as follows:  AN ORDINANCE REPEALING AND REPLACING ORDINANCE NO. 2018-03 CODIFIED AT CHAPTER 261 WITH A NEW ORDINANCE REGULATING FIREWORKS AND PYROTECHNICS IN MANHEIM TOWNSHIP, LANCASTER COUNTY, PENNSYLVANIA AND PRESCRIBING PENALTIES FOR VIOLATIONS THEREOF.  A brief summary of the proposed ordinance setting forth the provisions in reasonable detail are set forth below.  Section 1 establishes the title of the ordinance.  Section 2 sets forth the authority, intent and purpose of the ordinance.  Section 3 sets forth the definitions of terms used in the ordinance.  Section 4 identifies the referenced standards used in the ordinance.  Section 5 establishes the requirements and process for obtaining a permit to discharge fireworks, pyrotechnics and flame effects.  Section 6 sets forth the conditions, prohibitions and restrictions on the use of consumer fireworks.  Section 7 establishes the penalties for violating the ordinance.  Section 8 provides that ordinances, regulations and policies not amended shall remain in full force and effect.  Section 9 provides that if any part of the ordinance is found invalid, it will not affect the remainder of the ordinance.  Section 10 states that the ordinance shall take effect immediately upon adoption.  A complete copy of Ordinance No. 2021-17 as proposed together with any related exhibits are available for public inspection and may be examined by any citizen in the office of the Township Secretary 1840 Municipal Drive, Lancaster, Pennsylvania on regular business days between the hours of 8:00 a.m. and 5:00 p.m. A copy of the Ordinance also may be examined without charge at the offices of this newspaper (the Lancaster Intelligencer / New Era) and at the Lancaster County Law Library located at 50 N. Duke Street, Lancaster, PA 17602.  This meeting will be held in-person with masks required and appropriate social distancing enforced.   In addition, the public may participate virtually.  Instructions for participating virtually in Commissioners’ meetings are posted on the Township’s website (www.manheimtownship.org). The public may contact the Township during regular business hours with any questions.
